Settlement Allocation

Defining the method and structure.  The Garretson Firm serves as Special Master and Settlement Administrator for the courts and privately for settling parties.  We have extensive experience with delivering successful closure to settlements in pharmaceutical, product liability, environmental, civil rights, and church-related sexual abuse matters.  We are able to apply our vast and varied experience in prior settlements to each new project.

Perhaps the hallmark of our settlement allocation service, TGF helps ensure that similarly-situated claimants are treated the same under the methodology developed to allocate the settlement proceeds and to help ensure that every claimant is allocated a fair and equitable share of the settlement proceeds (taking into account the terms/conditions of the Settlement Agreement, the severity of the injury and the proof available). Some of the more salient tasks include:

  • Serving as Special Master (i.e. a neutral party experienced with assigning weights or monetary values to various injuries in mass torts or class actions).
  • Developing an allocation methodology
  • Reviewing medical records (to establish proof criteria for settlement eligibility)
  • Preparing summary sheets for participating claimants to review and acknowledge their assigned injury category based upon specific records reviewed
  • Determining award amount
